Why is the passenger arrested for drink driving?

perhaps the car had dual controls and two steering wheels, and they were blaming each other! (seriously, what is the true answer?)

Breathalyze both and then drop charges on one after establishing who the actual driver was.
I believe that is the tactic used because if the blame game was to drag on for some time and then one admitted the offence the evidence would be lost, so they take readings of all people in car and then the relevant reading can be used later. I think!!
