A LEGAL wrangle over a six-inch strip of land threatens to leave owners of new luxury flats, worth up to £1million, without parking. The Nirvana apartments in the Leas, Westcliff, are about to go on the market after five years - after developers finally managed to overcome economic difficulties and iron out planning snags. Now it has been revealed that the owners of a 100yards by 6in strip, which lays between the flats and neighbouring Bellway Court, have appointed a legal team alleging Nirvana’s developers do not have permission to cross their land to reach the concealed parking area. Although this is hotly disputed by the developers. The so-called ransom strip is designed to prevent encroachment into neighbouring land. The action is being taken by two of the three owners of the land, including Ashley Gore who does not live locally. His solicitor, Kevin Condren, said: “There is a ransom strip between Bellway Court and Nirvana. “We have sent a letter to the owner of Nirvana. “The matter will unfortunately be decided by a court. Solicitor Heather Millane acting for Mukesh Aggarwal, who owns the Nirvana development, said: “We have received a letter, but there is no merit whatsoever in this claim and we will be defending any action brought. We just think it has been done for nuisance value. “They do own the strip of land, but we have not trespassed on it. Surveys we have had carried out are quite clear about that. “We don’t cross that strip of land and even if we did we have got the right of way.”

Land is power!!

I'm sure the owners of the ransom strip will allow access for a few hundred thousand. Many builders keep a few feet of land back when building a house with the aim of offering it to the new owner for a few grand.

Saves working for a living - and its probably tax-deductible if the lawmakers are in on the act!!

There is a story that one of the three owners of the ransom strip was jailed for fraud and his assets seized under profits from crime, thus making this an incredibly complicated situation.

Who wants to live in this dreadful development anyway?

Prices could be £1milion for a flat blar blar blar....but going on sale at £400000 up(echo report wednesday)....Once the parking issue gets sorted.
These could be cursed....been abandoned once...and took 5 years to complete, you think they would have crossed all the i's and dotted all the T's....but a few inches are causing them a problem, they really don't fit in and how they got permission is amazing....cursed i'll tell ye.

I was just about to put a deposit on one, great balcony I thought! Facing the sea I'd be able to watch illegal shellfish pickers, the odd boat smashing through the Pier, Saturday night cruisers screaming up and down the road, maybe 1 or 2 illegal immigrants swimming ashore at the dead of night. What made me change my mind? No Bloody Airshow! :-)

So does this mean assuming this article is correct and there are now not enough parking spaces for the amount of dwellings in the building ,the original planning permission should never have been granted and therefore is now void . Will we be seeing bulldozers bought in to remove this building . Awaiting the outcome with intrest .

How permission was granted for this building in the first place I will never never understand. It is far too high, it should have been no higher than Admirals Court next door, just looks so hotch potch, reckon a few backhanders going on there with the council in order for that to have got planning permission!

Massive back handers i reckon....... one of the most scandalous planning decisions in this area ever ! there must be some very p*&%ed off residents living in the Leas, to the east......
